rule 1. Acceptable Use Policy

By accessing SmartFiQ platforms and API endpoints, clients agree to adhere to strict ethical and legal usage criteria:

• Clients must not use WhatsApp broadcast tools or AI voice agents to transmit unsolicited spam, deceptive phishing attempts, or illegal content.
• All WhatsApp messaging campaigns must comply with Meta’s Commerce and Business Messaging Policies, including prior opt-in consent for end consumers.
• Attempting to reverse-engineer, prompt-inject, or bypass security sandboxes of SmartFiQ AI agents is strictly prohibited.

copyright 2. Intellectual Property Rights

SmartFiQ retains all rights, titles, and ownership over underlying software frameworks, AI prompt architectures, custom CRM code, and proprietary algorithms.

Clients retain 100% ownership over their business data, customer records, workflow inputs, and generated business assets resulting from authorized platform use.

speed 3. Service Availability, Rate Limits & SLAs

We strive to maintain 99.9% operational uptime across our AI gateway servers:

• API Rate Limits: To prevent infrastructure overload, standard API tiers enforce dynamic request-per-minute rate limits. Exceeding limits will return standard HTTP 429 status codes.
• Scheduled Maintenance: Infrastructure updates are performed during off-peak hours with at least 24 hours prior notice to enterprise account admins.

shield_alert 4. Limitation of Liability

SmartFiQ AI Solutions shall not be held liable for indirect, incidental, or consequential damages resulting from third-party API downtime (e.g., Meta/WhatsApp API outages, OpenAI model latency, or external CRM service disruptions) beyond our direct control.
